Notice on Internet Fraud Prevention 

The Astana International Financial Centre Authority (“AIFC Authority”) hereby informs you of identified instances of internet fraud, where unauthorized individuals are illegally using the AIFC Authority trademark and trade name to mislead users for financial gain. These fraudulent schemes often target individuals, soliciting transfers to so-called electronic “security deposits” for various operations allegedly conducted under the AIFC’s name. 

Please be advised that, in accordance with the Civil Code of the Republic of Kazakhstan No. 409 dated 1 July 1999, and the Law of the Republic of Kazakhstan on Trademarks, Service Marks, Geographic Indications, and Appellations of Origin of Goods No. 456 dated 26 July 1999, the owner of a trademark holds exclusive rights to its use and disposal. No party may use a trademark protected in the Republic of Kazakhstan without the owner’s consent. Trademark usage rights may only be granted to another party under a licensing agreement by the trademark owner. 

In this regard, the AIFC Authority states the following: 

  • The AIFC Authority, as the holder of exclusive rights to the AIFC trademark, has no registered licensing agreements that grant the right to use the AIFC trademark. 
  • AIFC Bodies and their Organisations, and their employees do not extend financial services, investment opportunities, or any other transactions purportedly provided by them. 
  • AIFC Bodies and their Organisations do not provide financial services to individuals, do not open bank accounts for them, do not accept or execute monetary transfers, and do not carry out any financial operations on their behalf.

Please note that under the Administrative Offenses Code of the Republic of Kazakhstan No. 235-V ZRK dated 5 July 2014, unauthorized use of another party’s trademark, service mark, or geographical indication—or any confusingly similar designations for identical goods or services—as well as unauthorized use of another’s trade name, constitutes an administrative offense and may incur fines. When significant damage occurs, such actions may be classified as criminal offenses under the Criminal Code of the Republic of Kazakhstan No. 226-V ZRK dated 3 July 2014, which provides for criminal liability for fraud.
