Continuing Legal Professional Development Rules

  1. ONTINUING LEGAL PROFESSIONAL DEVELOPMENT RULES

    Guidance: the purpose of these Rules

    These Rules are adopted by the AIFC Legal Services Board in accordance with the sections 10 (f) and 21 (b) of the AIFC Legal Services Regulations to determine the requirements and standards for continuing professional development of Registered Legal Advisers.

  2. CONTINUING LEGAL PROFESSIONAL DEVELOPMENT RULES

    1. Commencement
    These Rules commence on 3 May 2023.

    2. Definitions, etc.

    Terms used in these Rules (other than terms defined in Schedule 1) have the same meanings as they have, from time to time, in the AIFC Legal Services Regulations and other AIFC Legal Services Board Rules, unless the contrary is stated.

    3. Application

    These Rules apply to the Registered Legal Advisors.

    4. Continuing Legal Professional Development requirements

    Subject to section 21 (b) of the AIFC Legal Services Regulations, Registered Legal Advisers must accumulate 8 (eight) CLPD points each Practice Year, where:

    (a) 4 (four) CLPD points must be obtained by completing ethics and legal skills courses set out in Schedule (2), from the AIFC Academy of Law; and

    (b) 4 (four) CLPD points must be obtained by undertaking other legal professional development activities as set out in Schedule (3).

    5. Obligation to keep record and duty to submit information

    A Registered Legal Adviser must keep a record in a form approved by the AIFC Legal Services Board of such Continuing Legal Professional Development undertaken to comply with these Rules for a period of 2 years and produce the record to the AIFC Legal Services Board on demand.

    6. Continuing Legal Professional Development undertaken pre-admission
    A Legal Adviser who has undertaken Continuing Legal Professional Development prior to his or her admission to the Roll shall be credited with the relevant number of CLPD points for the purpose of rule 4, provided that a record is kept in accordance with rule 5.

  3. ONTINUING LEGAL PROFESSIONAL DEVELOPMENT RULES 4. SCHEDULE 1: INTERPRETATION

    Continuing Legal Professional Development (CLPD) means any activity of intellectual or practical content, which serves to maintain or enhance a Registered Legal Adviser’s legal professional knowledge, skills, or ethics, or contributes to assuring the quality of legal services provided by the Registered Legal Adviser.

    CLPD points means the points credited to a course or other legal professional development activity, which a Registered Legal Adviser obtains by undertaking the continuing legal professional development in accordance with the requirements and standards established by the Rules adopted by the AIFC Legal Services Board.

    Practice Year means a period of 12 months commencing on 1 January and ending on 31 December each year of legal practice of a Registered Legal Adviser.
